Abstract

It can be considered as psychological ill-treatment an unjustified action of the heir that determines an impairment or injury, of the mental health of the testator or testator, including in this concept, the conduct of those who generated an act of contempt, family abandonment towards the mother, without any justification, and only attributable to the daughter. This action was expressly established by the deceased in her will, stating that «the action of her daughter supposes a cruelty that is as incomprehensible as it is unnecessary, martyring me at the end of my life, without any object» feeling «ignored by her daughter». Conduct of contempt and family abandonment that was evidenced in the last twelve years of the deceased’s life where, already with serious health problems, she was under the protection of her brother, without her daughter being interested in her or having any contact, this situation also extending to their grandchildren.
