Abstract

Action for liability under article 35 of the former Act of 19 December 1974 on Cooperatives cannot be held to be limited. The act set a three-year term during which action could be taken against the general manager of a cooperative for failure to discharge the obligations that, by law and other rules, the general manager was obliged to secure with a bank guarantee or insurance policy ensuring the reimbursement of the sums paid in advance by the members of the cooperative when the term was deemed to have been interrupted due to a criminal process, but not against the other members of the Governing Board, for whom limitation of action did apply.
