«Formalism as a Buyer Protection Measure in the Act on Timesharing Rights » conducts a study of the task that Act 42/98 assigns to certifying officers in the different phases of timesharing rights: from the creation of the timesharing scheme, which happens at the execution of the notarial deed (whose entry in the Property Registry is mandatory), to the transfer of the rights (requiring a written contract and, because of the legal configuration of timesharing rights, establishing the possibility of registering such rights), without overlooking the development phase. This study underlines how legislation trusts notaries and registrars to protect buyers and analyses the consequences of infringing the rules established in Act 42/98.
