Abstract

Article 139.2 of the Act on the Legal Framework for Public Administrations and the Common Administrative Procedure established the requirements that must be met in order for alleged damage to be indemnifiable: «At all events the alleged damage shall have to be actual, economically evaluable and individualised in connection with a person or group of persons». This article refers to the said requirements for damage and enters into an analysis of a very interesting practical case that the author had the occasion to study during her professional career and specialisation in this field.
