The cancellation of any registration entry is traditionally regarded as equivalent to an act of disposal for which maximum disposal capacity is required. However, article 178.2 of the Mortgage Regulation contains an exception to that general rule: In order to cancel mortgages registered to minors, the minors' parents do not require the same judicial authorisation as is demanded of them for acts of disposal under article 166 of the Civil Code. The reason for said exception is analysed, and a brief review is given of its legislative evolution and interpretation through jurisprudence.
