Abstract

Sharecropping is a contract whereby the owner of a property or farm temporarily cedes use and enjoyment of the property or farm or any operation thereof, or the elements of the farm, livestock, machinery or working capital, in the agreement that the owner and the sharecropper to whom this is ceded shall divide the products in aliquot portions. Sharecropping is legislated in articles 28 to 32 of the Rural Leasing Act. We have analysed the regulations for and duration of sharecropping contracts, the presumption of non-existence of an employer/employee relationship between the principal and the sharecropper, and the regulations for associative sharecropping.
