The new Rural Leasing Act (Act 49/ 2003 of 26 November), amended by Act 26/2005 of 30 November dedicates chapter VIII, spanning articles 24 to 27, to the topic of lease termination. It classifies the causes of lease termination into three categories: termination (article 24), cancellation (article 25) and rescission (article 26). To these causes must be added any causes the parties to the lease have expressly accorded in their contract, and because the Civil Code is applied in a supplementary capacity, the causes given in it must be added as well, such as extinctive novation and the confusion of rights between landlord and tenant. Article 27 regulates the effects of lease termination, and although systematically the article might be thought to refer to all causes of termination, cancellation or rescission, it refers to the effects of a specific case, the succession of tenants.
