This paper analyses a sale by the state of an economically unviable rural property to the owner of a neighbouring property under article 137.4.f) of Act 33/2003 on property owned by the public authorities. There is a commentary on the Directorate- General of Registries and Notarial Affairs' decision of 8 May 2008, which holds that the purchase was made exercising a preferred legal right to purchase the land, and so the purchase is considered made exclusively by the individual and cannot be presumed to have been made as community property under article 1361 of the Civil Code. Such a presumption is overruled by the purchaser's title, which states the purchase to have been made by the private individual. Even so, the marital partnership is entitled to reimbursement of the money invested in the purchase.
