The new wording of article 1732 of the Civil Code introduces preventive empowerments in our legislation and consequently opens the door to voluntary representation of the incapable individual, which permits the maintenance of the autonomy of will of a person who, while capable, can foresee a loss of his own capacity. However, many are the doubts now raised: Is the autonomy of will of the person concerned limited by the rules on guardianship? Can voluntary and legal representation coexist? Are there limits to the contents of the power of attorney?
