Abstract

Chapter VI of the Rural Lease Act regulates expenses and improvements, stating who has the right or duty to have improvement and upkeep work done on rural property. The general rule is that both the landlord and the tenant are obligated to permit any construction, repair and improvement work that the other party to the lease must or may do, and such work must be done at the time of the year and in the fashion that cause the least disturbance, unless the work cannot be delayed. The landlord is obligated to do any construction or repairs needed to keep the property in the proper condition so that it can be used for the purpose stated in the lease. The landlord also has the duty to perform any construction work or improvements or make any investments that are required by law or by a final judgment or administrative decision. The tenant, on the other hand, has got to make any repairs, improvements or investments characteristic of the owner of an agricultural concern, and it is presumed that the improvements made during the lease have been done at the tenant's expense.
