Abstract

The termination of a rural lease relationship and its effects are regulated in sections 24 to 27 of the Rural Lease Act. The act distinguishes between three different legal concepts: termination, cancellation and rescission. We have analysed the causes at the root of each, to which causes must be added any causes that the parties to the lease have expressly agreed to. The Civil Code is applied as a supplementary framework. We have also analysed the effects stemming from the termination of a rural lease, in which case the outgoing tenant must allow the incoming tenant to use the premises and other means necessary for the following year's preparatory work, and reciprocally the incoming tenant is obligated to allow the outgoing tenant all that is necessary to gather and use the fruits of his labour as provided for in article 1578 of the Civil Code.
