Abstract

Even though the Bankruptcy Act is from 2003, only with the wider spread of the present economic crisis have the multiple issues stemming from the application of the act arisen in practice. The connections between bankruptcy and registration are, due to their own nature, frequent; and, both now and before the Act, they always entail complex situations in which a registrar's scrutiny of documents for due legal form appears as something tacked onto the legal issue at the real heart of the case. Yet, sometimes the registrar's scrutiny has substantial ramifications. In the insolvency situations now arising (largely in the real estate sector), the rich variety of the types of land development processes at issue also has its impact on bankruptcy rules, and there is no clear model addressing the point. That is why, concerning the two resolutions commented upon, we have sketched out some of the problems that have already been commented upon for years and will surely be the object of further attention in future.
