Although the legislation applicable to succession is the legislation for the deceased's legal residence, in this case of common law, the legal nature of real property lying in territory having special laws under the historic territorial privileges called fueros is neither lost nor changed. Such real property continues to be stem-family property and therefore must follow the trajectory set for such property by País Vasco law. Stem-family property ownership constitutes a limitation on the legislation applicable to succession. The fact of having lost one's legal residence in Vizcaya does not entail any restriction whatsoever of rights and duties of any nature stemming from stem-family property ownership.
