The majority of legal doctrine and courts hold that, while a declaration of bankruptcy does affect any ordinary foreclosure on the family home begun before the declaration of bankruptcy, a declaration of bankruptcy does not freeze or suspend mortgage foreclosure on the family home. However, an interpretation can be offered that is in tune with social reality in the current context of economic crisis. The interpretation that is being accorded to articles 55.4 and 56 of the Bankruptcy Act involves some discrimination with respect to bankrupt business owners or enterprises, and the interpretation in this paper addresses that discrimination. In the event such an interpretation is not accepted, various proceedings are analysed that avoid foreclosure or limit the sum the lender may claim under the creditors' agreement or collective liquidation.
