Abstract

The obligation to provide sibling maintenance is a derivative, supervening family obligation due to the family tie based on family solidarity. It is inspired by the constitutional rule of equality before the law. A comparable right to maintenance exists amongst all manner of siblings, and one of the essential traits of the right is reciprocity. In addition to the tie, the requirements are that the recipient must be in a state of need and the provider must be economically capable of providing maintenance. The right exists as of the exact time when the recipient enters the state of need.
