The ruling of 17 December 2010 of the Second Section of the Provincial Appellate Court of Navarra states that, when an award is made as payment in a mortgage foreclosure case, the real value assigned to the mortgaged property is the appraised value originally quoted in the mortgage deed. Therefore, foreclosure may pursue other assets belonging to the borrower only in order to cover that portion of the loan that surpasses the property's appraised value. This study endeavours to demonstrate that a ruling of this sort is based on legal grounds and is not contrary to current legislation.
