Abstract

The decree of 26 October 2010 of Barcelona Commercial Court Number 3 grants conditional exoneration of the liabilities outstanding after liquidation in bankruptcy, in a restrictive interpretation of section 178.2 of the Bankruptcy Act. This paper endeavours to ascertain whether the dysfunctions the judicial authorities have detected in the application of the Bankruptcy Act and article 1911 of the Civil Code can be smoothed over by means of the right interpretation of the precepts involved, so as largely to remove the grounds for decisions such as that featured in the case in point. The advantages and drawbacks of adopting the fresh start concept, in judicial proceedings or in legislation, are also analyzed.
