Abstract

The spendthrift is the person who of habitual form wastes his heritage of untid and unthinking form, without we are before a supposition of disability in the sense of article 200 of the Civil Code, but before a restriction or limitation of the capacity of action of a subject that puts in danger the food rights of the relatives who have right to perceive them or to be in situation to proclaim itself them. There is protected a private familiar interest (food right of spouse, descendants or ascendancies) without such a protection reaches the declared spendthrift. One submits him to guardianship, determining the judgment that concrete acts the bountiful one must realize with the assistance of the guardianship, so it's not this one a legal representative so, in last term who consents is the spendthrift.
