Abstract

The exercise of the parental authority presents a complex set of rights and obligations, of great responsibility and that acquires greater complexity in cases of separation or divorce. The distribution of functions between the parents is not an easy task nor Pacific generated a number of clashes between the sides despite the care with which the judge and the legislature have arranged them. The establishment of agreements between the parties in the event of crisis in the couple is another way to address the problem by some more modern legislation. Within these duties, it raises if the change of domicile to the parent custodian corresponds to it, or if on the contrary, it is a common parental decision. The consequences can be sensitive, if the change of domicile is in a foreign country. The jurisprudence has been interpreting the order in a way that despite the conflicting interests, the primacy continues to be ate.
