Abstract

This paper analyses the doctrine of the Spanish Constitutional Court regarding the Generalitat Valenciana"s competence to legislate on Civil Law. The author exams the dijferent decisions until now, specially the most recents, which have avoid the Ley de Régimen Económico Matrimonial Valenciano, the Ley de Parejas de Hecho Formalizadas and the Ley de Relaciones Familiares de los hijos e hijas cuyos progenitores no conviven, all of them from the Comunidad Valenciana. Also the author analyses the dissident vote of the Judge Mr. José Antonio XIOL RÍOS and shows his compliance with those sentences, which have established the constitutional boundaries regarding the competence to legislate in Comunidad Valenciana.
