Abstract

This paper analyzes the complex regulatory framework to which tourist housing is subject in the Spanish legal system and studies the nuisances and major controversies that they generate in buildings subject to a horizontal property regime. It examines the possibilities of action available to communities of owners to deal with these situations, in light of the new section 12 of Article 17 of the Spanish Horizontal Property Act introduced by Royal Decree-Law 7/2019 of 1 March, on urgent measures in housing and rental.
