Abstract

The ambit of tourist apartaments is, in Spain, a controversial ambit, because of multiple reasons. Not the least of them is the legal fragmentation in Spain, with abundant autonomic regulations, not always harmonious. In this complex area, the transfer of these apartaments by rooms is a possibility that deserves to be addressed, as an interesting tourist product.

This paper pretends to study what these various regulations establish in this question, how our courts have ruled, as well as whether the contract itself has entity and deserves to be accepted by the Law, so that individuals can celebrate it.
