Civil aspects of domestic work: qualifications to art. 1438 CC.

Abstract

The right to compensation for domestic work, generally agreed by both spouses, and expressly contemplated in matrimonial property regime of separation, is put up for debate.Should the spouses compulsorily contribute with domestic work as a matrimonial burden? Can a spouse contribute to such work by hiring a domestic worker? Can a spouse claim this right if he has reduced his paid work for family conciliation? These and other questions are tried to be answered in this paper.
