The leasing of a room in a building on horizontal property

It is increasingly common to conclude room rental contracts in apartments that are subject to a horizontal property regime. One of the reasons f this, probably, is to avoid with these leases the demanding conditions of tenant protection established by the LAU. The increase in these rents leads us to consider, first of all, what is their nature, regime, and possibility of establishment in a horizontal property; But, in addition, they sometimes generate inconvenience to neighbors, overcrowding in apartments, which leads to questioning whether they should be allowed or prohibited by the community, or, if applicable, how to deal with the inconvenience derived from them. In this article we analyze all the peculiarities of this lease when it is established in a condominium apartment.
