The repeal of the suspension of effects of the registered public faith. concerning the article 28 lh

Abstract

The recent repeal of article 28 LH by Law 8/2021, of June 2, which reforms the civil and procedural legislation to support people with disabilities in the exercise of their legal capacity, puts an end to the suspension of effects of the registered public faith during the period of two years, when a property was acquired from an heir or legatee of the previous registry owner. We analyze in this article the basis of said suspension of public faith, the requirements for its application.  We try to reponse if it makes sense today to suspend the main effect of the Property Registry that provides security to legal traffic.
