Abstract

The limited success of Alternative dispute resolution systems (ADS) in Spain justifies a critical analysis of their institutional design in order to identify the cause, rationally promote their initiation, and make an agreement more likely, which will make it possible to improve the legislation in the pipeline, such as the Draft Bill to promote mediation and the Draft Bill on procedural efficiency measures for the public justice service.
