The dilemma of the limitation period for mortgage expenses has brought about various positions in Spanish jurisprudence. This has led to the raising of several preliminary questions, all of them with the same objective, the achievement of a response, by the EUCJ, that makes it possible to elucidate when the limitation period for the restitution of what was unduly paid begins to run.
