Critical notes in relation to the recent jurisprudential interpretation of credit information files

In this work, we will reflect on the interpretation that the first chamber of the Supreme Court is making, in relation to the requirements of legality of the processing to register debts in the credit information files contained in the Organic Law on the Protection of Personal Data. In addition, special emphasis will be placed on the possibility of establishing compensation for damages arising from incorrect inclusions in the files, based on the compensation regime provided for in the European General Regulation on the Protection of Personal Data.
