Legal regime applicable to the rental and subletting of rooms intended for permanent housing

In recent years, there has been a growth in the rental of rooms for permanent housing, mainly due to the high rental prices in relation to the income level of many citizens. However, this type of rental has no regulations. In the absence of a unanimous position neither in the doctrine nor in the minor jurisprudence, this paper studies the legal regime applicable to the lease, but also to the sublease of room for this purpose, both if who rents is the tenant of housing, as if it is the tenant for use other than housing. The proposed regulation of this contract, drafted by the Obligations and Contracts Section of the Codification Commission of Private Law of Catalonia, is also presented.
