This article examines the age-old debate of the numerus clausus or numerus apertus system for in-rem rights. The controversy has died down nowadays, as the numerus apertus scheme for real rights has been comfortably accepted, although with certain limits or limitations on its acceptance. This is because the acceptance of new types of rights must be controlled and must meet the demands of the principle of speciality, due to the erga omnes effects of in-rem rights and the duty of respect that they generate.
