Abstract

Relative simulation consists in creating a sham transaction as a cover for a truly performed transaction that remains hidden. The real intention is for the hidden transaction to prevail amongst the parties, while for third parties the hidden transaction's importance is outshined by the declared intention in view of the general interests of trade and the requirements stemming from good faith and the rule of protecting legal appearances.
