Abstract

This paper conducts a historical study of the system of rules applicable to the professional staff at the Directorate- General of Registries and Notarial Affairs, who have not always been drawn from a specific corps of functionaries. At present positions on the professional staff are filled by notaries and registrars assigned to that task, and it is the system of legal and regulatory rules pertaining to them that is analysed in this study.
The entrance system, the functions involved and the existence of the right to similar standing bring staff positions into close resemblance with the attorneys at the Directorate-General of Registries and Notarial Affairs, according to jurisprudence. Jurisprudential doctrine has had to give pronouncements on several occasions, as a result of sundry appeals for judicial review, and has always found in favour of regarding professional staff positions as specific functionary positions (therefore not to be confused with registrars and notaries on secondment), and in connection with the right to similar standing.
