Abstract

The right to contract marriage used to be configured as a constitutional right, whose exercise could neither affect nor, of course, weaken either spouse's legal position in the marriage, on the basis of the spouses' legal equality. Social reality has made for a different conjugal situation today, and consequently, in addition to having the duties to live together, be faithful and provide mutual aid, spouses also have the duty to share domestic responsibility and the duty to care for certain family members.
