Abstract

Despite what the colonial period might lead one to think, Morocco's registration system is not based on French law, but is an original system close to Australia's Torrens Bill but with a number of very different circumstances, since Moroccan land is nothing like a terra nullius. Accordingly, the Kingdom of Morocco is making a terrific effort in the ex novo registration of properties. The explanation of how this first registration process is being carried out under the Moroccan mortgage system is the subject of this paper.
