Abstract

As a result of the Directorate-General of Registries and Notarial Affairs' decisions of September 2005, Spanish legislation admits mortgages subject to suspensive conditions. The admission of mortgages of this type is disputed by doctrine, in terms of both their validity and the difficulties that their admission may cause in practice. Both aspects are analysed here.
