APUNTES PARA UNA HISTORIA DEL MODO DE EXPRESAR LA REPRESENTACIÓN EN LAS ESCRITURAS PÚBLICAS.

Abstract

Article 98 of Act 24/2001 of 27 December changed the very root of the traditional Spanish system for expressing, in a deed, that a party is acting on behalf of another. This paper proposes a recapitulative study of the rules, case law and scientific doctrine that have indicated how to proceed on this point since the modern notarial scheme and property registration system arose in Spain. This focus endeavours to underline how article 98 broke with tradition and encourage reflection on the scope that can have for the set of institutions affected by the change.
