Abstract

In regard to the Supreme Court's recent ruling of 19 December 2006, this paper addresses the problem of the acknowledgement of legal personality for irregular companies, as this topic is under considerable doctrinal debate and remains unclarified by case law. The system of liability of the partners in irregular companies is also analysed, following the train of said ruling and according to the treatment of said system.
