Abstract

The dramatic arts generate intellectual property rights of a different nature. First, the copyright belongs to whoever created the work that is being performed or staged. Then, there are similar rights for the performers or stagers, such as the producer and orchestra, whose action makes it possible for the attending audience to gain a natural enjoyment of the show. Both meet in the same reality or stereotype. This meeting sometimes generates conflicts between the respective holders of the two types of rights, i.e., between authors and performers. The concentration of both rights in the figure of the theatrical impresario by means of what are called «stage contracts» delimits the positions of the major players taking part in the work and its performance, making it possible to stage the work.
