COMPENSATION FOR LATE PAYMENTAbstract
The Supreme Court's ruling of 1 March 2007 unifies doctrine in its interpretation of article 20.4 of the Insurance Contract Act. The ruling states that the interest on delayed payment that the insurer must pay the injured party must be calculated at the legal rate plus 50% for the first two years following the loss, and after that time at the rate of 20% unless the former calculation is higher. This puts an end to the different provincial appellate courts' arguments over the interpretation of the article.
