Abstract

With the registration-related measures the Royal Decree of 14 January 2005 declares for the disclosure of realestate information, the first specific regulations are enacted on access to registration for a set of anticipatory steps designed for the knowledge and restoration of potentially polluted land. For the registration sphere, this is a major contribution toward the defence of the environment, an issue of great interest in present-day society. The measures have general effects on immovable property trade and particular effects on development processes, because of the need to link development institutions with the effect stemming from polluted land, in the interest of all of society and in the interest of the parties directly involved in development. This is especially important in view of the multiple interferences of all sorts concerning the environment. There is no consolidated doctrine addressing such interferences, as shown by the ruling of the Superior Court of Justice of Castilla y León in Burgos, which made a superficial assertion about the burden of restoration.
