Abstract

The reform of the 1990 Land Act introduced registration-related precautionary measures in processes relating to action under administrative law, although a general configuration was given later by the new Civil Proceeding Act, despite the implementation produced by the rules contained in the Royal Decree of 4 July 1997. When these precautionary measures were put into operation in judicial and registration practice, they gave rise to a rich variety of situations in which the particular features of the litigious process (in which the process takes precedence over the act) have got to be integrated with the structure of the registration system and even with normal usage and custom under regulations implementing the Civil Proceeding Act, insofar as said usage and custom have to do with historical models put into practice after dozens of years in which the only testimony was that of the civil process. These comments respond to all these aspects.
