Abstract

A usufruct is characterised by the fact that it sets limits concerning form and substance in the use and enjoyment of the thing in usufruct, salva rerum substantia. However, this limitation can be avoided when the document creating the usufruct system so states. Different types of special usufructs can thus be created. One such usufruct is that in which the usufructuary is granted the power to dispose of the property in usufruct. This article analyses the possibility of this system's admission, its justification, its limits and, in short, all its special requirements, which make it an extraordinary type of usufruct.
