Abstract

The Supreme Court's ruling of 19 December 2007 addresses such topics of interest in corporate law as the civil or commercial classification of an enterprise intended primarily for the rendering of transport services and the validity of clauses on the free transferability of interests in partnerships. This paper analyses not only the above but also the violation of the duty of non-competition by the partners in a partnership and the ejection of partners who violate that duty, as the sentence may have been influenced by this additional facet.
