Abstract

The Directorate-General of Registries and Notarial Affairs has accepted the registration of land and subsoil separately, even when one falls under a public legal framework and the other, a private legal framework, provided that they are combined in the characteristic relationship established by the by-laws of real-estate complexes or developments. Other alternatives are envisaged, however, as hypotheses in the Decision of 27 February 2007. Act 8/2007 of 28 May on state land redefined the concepts of «a property» and «a lot» and determined when a realestate complex can be created in a situation where public and private ownership are superimposed. In our opinion the new legal framework agrees with the doctrine of the Directorate- General, inasmuch as the latter demands interdependence of the registration folios where the rights in the land and subsoil are to be published; any other interpretation would hamper access to registration of the rights created in this process.
