Abstract

The law is the sole source of extracontractual liability, if there are agreed to terms, consent and clauses reflecting the source of the obligations to be discharged. The law only acts in the negative or prevention sense or the positive or complementary sense when it has a role to play in establishing the consequences of the agreed-to terms. The imperative nature of a contract does not rest on the wishes of the parties, but is instead imposed by legislation.
