Abstract

Fair title is a necessary requisite for ordinary usucaption. In order for a title to be considered «fair», and therefore for the periods of time involved in the usucaption process to be shortened, the title must be fair, true, valid and proved. This paper analyses how jurisprudence has interpreted and honed each of these requirements. A study of the relationship between fair title and the property registration system is also given, taking a particular look at the issue of whether registration is directly equivalent to fair title or not, as may be gathered from article 35 of the Mortgage Act.
