Abstract

More and more modes of rental are appearing nowadays, causing a shift in views from the traditional Roman maxim, Res movilis res vilis, to concepts of operational leasing that are accruing great social, economic and legal importance and proving themselves especially meaningful in the sector of industrial equipment, contracts and services. In this paper we attempt to analyse the leasing of personal property. The importance of the chattel leasing business contrasts with the lack of legal regulation on the matter. From the legislative standpoint, the doctrinal standpoint and the standpoint of case law, we have examined the essential features of chattel leases, the registrationrelated aspects of chattel leases and the laws applying to chattel leases, analysing the differences between these and other kinds of leases, such as financial leases and operating leases.
