The new Spanish law on international adoption responds to an obvious social as well as legal need. In just ten short years Spain has taken a place amongst the leading makers of international adoptions, as children have arrived from abroad in order to join Spanish families. These have been years characterised precisely by an authentic child protection system «revolution», which called for the singular institution of international adoption to be reformulated from the standpoint of the new «key concepts». This article gives a critical analysis of the terms of the new law. It endeavours to mark the bounds of the law's object, discern the spirit behind the law and analyse whether the law has adequately addressed the delicate question of cognisance and how the law has responded to the regulation of the administrative phase and the judicial/registration phase of international private law.
