Abstract

A real right of easement may be created tacitly, that is to say, without the owner of the easement ever expressly stating his intention to create such a lien. That would be the creation of an easement by an apparent sign or intention by the pater familias. This study analyses the foundations, the requirements and the unique constitutive effects of this very particular case. The analysis is based on case law dealing with the subject.
