Abstract

The Council Regulation (EC) 864/ 2007 of 11th July de 2007 on the Law applicable to non-contractual obligations («Rome II») represents one of the most relevant legal instruments for current Spanish Private International Law in the first years of the XXst Century. This Council Regulation Rome II intoduces a set of general conflct-Of-Laws rules to specify the Law applicable to non-contractual obligations. Those Conflict-Of- Laws rules combine, in equal proportions, the anglosaxon flexibility and continental legal certainty. This Council Regulation Rome II is, also, the forefront of a completely new European Private International Law which aim is to avoid Forum Shopping and to enhance free movement of individuals within the UE.
